Maternity leave pay entitlements under the NHS scheme

At the beginning of the 11th week prior to the anticipated week of childbirth, if you have 12 months of continuous service with one or more NHS employers and you have informed the NHS of your intention to return to work, you are eligible for the following benefits:

  • 8 weeks of full pay, minus any Maternity Allowance or Statutory Maternity Pay (SMP) (MA)
  • Half pay for 18 weeks plus any MA or SMP (providing the total does not exceed full pay)
  • SMP for 13 weeks or MA
  • 13 weeks of unpaid time off.

It is possible to work out a different payment plan for the occupational pay entitlement with your employer, such as spreading it out evenly over the duration of your maternity leave rather than paying you for a portion of the time at full pay and the rest at half pay.

Who is entitled to NHS maternity pay?

Doctors entitled to the NHS maternity scheme are:

  • junior doctors
  • consultants
  • specialty doctors
  • associate specialists

How is your total pay calculated?

Your average weekly earnings for the eight weeks leading up to and including the fifteenth week before the anticipated week of childbirth are used to calculate your maternity pay.

In addition, regular contractual payments, such as London weighting and banding supplements for young hospital doctors, are among the earnings that will be taken into account. Members should consult their employing authorities or trusts to confirm their personal status.
